Stock Market News The SEC's new Rule NMS passed by a 3-to-2 margin Wednesday after SEC Chairman William Donaldson voted with two Democrats against two fellow Republican Commission members.

Stock Investing Software In commenting on the SEC commission's decision to approve the new stock trading rules, Donaldson said that today's vote "strikes the right balance between market competition and order competition, while at the same time providing incentives to all market centers to improve their speed and efficiency." Donaldson said that the alternative was to do nothing.

Stock Market Trading What garnered the most attention from Wall Street was the "trade-through rule" of Regulation NMS. In the view of regulators, the new rule provides the best share price protection for the Nasdaq stock market, which is traded electronically. The trade-through rule marks the first time protection has been offered of this nature. Though the move by regulators was steeped in controversy as institutions lobbied to prevent Donaldson's action in approving Regulation NMS Wednesday.

Stock Investing For Dummy Donaldson had said before Wednesday's vote that previously, traders could bypass, or trade through, the best price offered for a stock to the disadvantage of customers. In effect, shortchanging investors.While Donaldson had sided with Democrats, Republican House representative Richard Baker of Louisiana said he may challenge the SEC's move in Congress.Rep. Baker said that the new rule is unnecessary, that it was anti-competitive, as the Nasdaq Stock Market was traded electronically.

Stock Market Crash Cynthia Glassman and Paul Atkins, the two dissenting Republican members of the SEC commission said they would file a written dissent to the proposal, saying it placed additional cost burdens on US markets as wells as further bureaucracy.

Stock Investing Tip Donaldson said his vote was in view of protecting small investors.

Stock Market Chart Earlier, in a 5-to-0 vote, the SEC commission had approved the so-called "Merrill Lynch" rule that allowed exemptions to brokerages offering "fee-based" accounts an exemption from the same regulations as investment advisers.
