Stock Market News Martin went to court to block the transfer and initially won a temporary restraining order. But earlier this month U.S. District Judge Richard W. Roberts lifted the order, ruling that Martin had not exhausted possible administrative remedies to the dispute. Martin has now taken his case to the Office of Special Counsel, a civil service agency that handles disputes within the federal bureaucracy. Thomas Devine, legal director of the Government Accountability Project, which has represented Martin, said he will argue that yesterday's resignation was a "constructive dismissal" that was forced on Martin by EPA officials.
